Updated: 9 December 2022
As a business of reputation and trust, Tokopedia is committed to protecting Intellectual Property (IP) and ensuring the safety of our platform. Tokopedia acknowledges our IP protection principles on our IP Protection site.
IP Protection Practices:
Provide IP owners and brands with seamless channels to report products believed to be in violation of IP.
Tokopedia offers a number of channels for brands and IP owners to submit and track IP claims.
● IP reporting portal and claim tracking/br>
● One-time report of products
● Contact the IP Protection team
● Report this product feature on every product description page
Implement efficient procedures to handle and process IP claims.
Tokopedia provides a fair and thorough process in addressing IP reports.
● Validation of documents, such as:
○ IP rights documentation - e.g. Trademark, Copyright Certificate
○ Identity documents of the complainant - e.g. ID card, statement letter of employment, Power of Attorney, Letter of Authorization
● After documents have been validated, reported products are taken down accordingly
○ Sellers and IP owners will receive notification regarding the IP claim
Maintain timely response for IP reports/claims.
● IP claims are expected to be processed in under 2 business days
Partner and cooperate with IP stakeholders and brand owners.
Tokopedia has Trust & Safety and IP Protection personnel who engage with IP owners and brands regarding IP protection and anti-counterfeiting initiatives.
● VP, Risk Management & Compliance - Julian Wong
Proactively prevent IP infringement through automation and technology.
Tokopedia’s automated monitoring proactively blocks infringing product listings and flags suspected cases for further manual investigation.
● Detection rules checking various product attributes
● Image detection techniques and optical character recognition (OCR)
● Machine learning models detecting suspicious IP infringement patterns
Employ strict repeat infringer policy and review of sellers.
Tokopedia has a strict repeat infringer policy. Sellers are reviewed starting at account registration and reviewed closely for compliance with product policies through a scoring system. Any seller who accumulates repeat offenses or violations becomes restricted from listing products, suspended, or permanently removed from the site. Tokopedia prevents previously banned sellers from setting up accounts again.
● Seller penalty point system to prevent repeat offenders from relisting
Educate sellers on IP policy.
Sellers are educated as soon as they join the platform and throughout their seller journey. Tokopedia provides content resources to help sellers understand our IP policies. This education information, along with violation and suspension notification, is regularly communicated to them through email, seller notification center, and seller dashboard.
